Prinsjesdag Foal Auction 2026

General

  1. Veulenveiling Prinsjesdag BV (hereinafter: 'VP') is organizing multiple auctions (hereinafter: 'the Auction') in 2026.
  2. The relationship between VP and the seller is a contract of services.
  3. These auction terms and conditions apply to the relationship between VP and the seller and to the relationship between VP and the bidder/buyer. Both the seller and the bidder/buyer participate in the Auction entirely at their own expense and risk. Under no circumstances is VP held liable towards the seller and the bidder/buyer for any obligations other than those described in these auction terms and conditions. By registering and bidding, both the seller and the buyer agree that the auction may contact them via the provided name and address details. Partners of Veulenveiling Prinsjesdag may also contact them for promotional purposes and information.
  4. A purchase agreement is concluded exclusively between the seller and the bidder/buyer. The bidder/purchaser is, however, obliged to sign the written purchase agreement as referred to under 11. VP is not bound by any agreements between the seller and the bidder/buyer. Under no circumstances can VP be regarded as a seller or bidder/buyer.
  5. All stipulations in these auction conditions are also made for the benefit of all those who work or were working for or on behalf of VP. The provisions in these auction conditions apply directly to these (legal) persons, as if they were VP themselves.
  6. Participation in the auction is regarded as acceptance of these auction conditions. Any conditions used by a seller or bidder/buyer are hereby expressly rejected.

Auction

  1. VP or a selection committee composed by VP examines and selects the embryos/foals that are eligible to participate in the Auction. VP/the selection committee is hereby authorized, but not obliged, to seek advice from third parties. VP/the selection committee has the right at any time to refuse the participation of a foal or foals in the Auction on the grounds of (physical) defects, as well as for other reasons to be determined by VP/the selection committee, even if a foal or foals have already been the Auction has been selected. A participation decision by VP/the selection committee is binding. VP/the selection committee is/are never obliged to reimburse the costs incurred by the seller on any grounds whatsoever.
  2. The selected foals are sold immediately without action or reaction, in the condition they are in at the time of award, in order to be reared by the bidder/buyer into an adult horse. The foals are sold by auction. If no opening bid is made, the auctioneer is authorized to start with a reduced opening bid. The auctioneer has the right to change the order of the foals to be sold or to refuse persons as bidders/buyers without giving reasons.
  3. Bidders/buyers are expected to be fully legally competent and of sound mind. Every bidder/buyer is deemed to have bid for himself and is bound by his bid until a higher bid has been definitively accepted. A bidder/buyer is fully liable, in addition to any principal, for failure to fulfill his obligations. A seller who buys back his foal is considered a bidder/buyer and all provisions in these auction conditions that concern bidders/buyers also apply to the seller referred to here.
  4. Only upon delivery of the foal by the seller to the bidder/buyer, does the risk in respect of the foal pass from the seller to the bidder/buyer immediately.
  5. The bidder/buyer will sign a written purchase agreement immediately after the award, showing identification. If the purchase agreement is not immediately presented to the bidder/buyer for signature, he must report to the VP secretariat immediately after the auction.

Information

  1. VP has attempted to compile the catalog with selected foals for the Auction (hereinafter: the 'Catalogue') as accurately as possible. The information contained herein, including, but not limited to, the pedigrees, is aimed at giving an impression of the quality of the foals, without pretending to be complete.
  2. It is the responsibility of the seller to check the accuracy of the information in the Catalog and to inform VP voor de Auction in writing of any errors/omissions and necessary changes/additions. The extent to which any changes/additions are included in the Catalog is at the discretion of VP.
  3. Prior to the photo/video days, the seller is obliged to provide VP with a veterinary report at his expense, from a recognized veterinarian designated by him. The seller must provide the aforementioned report to VP prior to the photo/video days. During the aforementioned photo/video days as well as on the auction day (in the case of a physical auction) prior to the Auction, a veterinarian appointed by VP will be present who, on behalf of and at the risk of the seller, will inspect the registered foal and check the aforementioned veterinary report. A clinical examination will take place. If this veterinarian finds inaccuracies or omissions, he will attach his findings to the previously drawn up veterinary report. On the day of the Auction, the seller and bidder/buyer can view a copy of the veterinary report including any attached findings.
  4. At VP's request, bidders/buyers are obliged to provide information regarding their financial solvency, substantiated by documents demonstrating this solvency.

Cost and payment

  1. All rates and prices in these auction conditions are exclusive of VAT. VAT is charged on the purchase price and the commission amount.
  2. The commission amount payable by the seller is determined on the basis of 12% excl. VAT. The minimum entry fee of € 500 excl. VAT per foal and the minimum entry fee of € 500 excl. for an embryo are due by the seller to VP from the moment the seller has signed the contract.
  1. foals; If the highest bid comes from the seller of a foal, he will not owe a buyer's commission up to and including € 7,000. If this bid is higher than €7,000, the seller owes both the buyer's commission and the seller's commission.

Embryos; If the highest bid comes from the seller of an embryo, he will owe an additional €500. If this bid is higher than € 10,000, the seller also owes the buyer's premium (buyer's commission), in accordance with the provisions of paragraph 20 and following of these conditions.

  1. The seller must pay the minimum amount of registration fee to the bank account of Veulenveiling Prinsjesdag BV within 14 days after the invoice date, stating the invoice number. Only after receipt of the aforementioned amount, or proof of payment, will the seller and his foal(s) be admitted to the Auction.
  2. The bidder/buyer must pay the purchase price, plus 12% premium excl. VAT on the purchase price, as soon as possible after receipt of the invoice. In euros without any discount or deduction.
  3. If the buyer does not fulfill his obligations under paragraph 20, VP has the right to re-auction the foal/embryo, whereby the original buyer's bid will not be accepted. The original buyer is obliged to pay VP the difference between his bid and the lower purchase price at the second auction, as well as the associated costs. The buyer has no claims against VP if a higher proceeds are realized at the second auction.
  4. Foal auction Prinsjesdag does not sell to sanctioned countries. Furthermore, Foal Auction Prinsjesdag is not liable for any resale to third parties in sanctioned countries.
  5. Only commission agents recognized by VP who have indicated in writing to the secretariat of VP before the start of the auction that they are acting for one or more of the bidders/buyers can claim commission from a sales amount of € 22,000 excluding VAT per foal or embryo. This commission amounts to 5% excluding VAT on the entire purchase price. After signing the purchase contract, the commission agent will be equivalent to being a buyer and will be held to the obligations stated in these general terms and conditions and will be responsible for correct (financial) settlement. After the bidder/purchaser has fully fulfilled his (payment) obligations and the foal has been delivered to the buyer, VP owes the commission, no sooner than two weeks after delivery.
  6. Payment to anyone other than VP does not release the seller or the buyer from its payment obligations towards VP. As long as VP has not received full payment from the buyer, the seller remains the owner of the foal.
  7. If VP has not received full payment from the seller and/or buyer within 30 days of the auction, the seller and/or buyer will be in default by operation of law and will owe VP compensation in the amount of 12% over the purchase price, plus interest. of 1.5% per month on the total amount due, to be calculated from the auction until the time of full payment. All this without prejudice to VP's right to compliance and/or compensation.
  8. If VP has not received full payment from the buyer within 30 days of the auction, VP is furthermore entitled to consider the sale as dissolved without notice of default on behalf of the seller and without his consent. In that case, the seller and the buyer remain obliged towards VP to fulfill all their payment obligations referred to in these auction conditions, insofar as these relate to compensation for the benefit of VP.
  9. If the buyer or the seller fails to fulfill its (payment) obligations towards VP, all (extra)judicial costs incurred by VP will be borne by the buyer or the seller, with a minimum amount of € 1,000.
  10. If there is a foal with a known defect for which a veterinarian appointed by VP has stated in writing that recovery (cure) is possible, the buyer is obliged to fulfill his obligations in accordance with the conditions in paragraphs 20 to 27. In the event of death or rejection of a foal by the aforementioned veterinarian, who makes a binding decision regarding the health condition of the foal, before the expiry of the period within which delivery should have taken place by the seller to the buyer, the purchase agreement is considered dissolved and the purchase price plus any VAT due will be refunded by VP. The registration fee and the buyer's premium will not be refunded by VP to the seller or the buyer respectively, or will remain owed to VP. With regard to the period(s) within which delivery of the aforementioned foal with defect must take place, reference is made to the provisions of sub 36.
  11. If and only after all (payment) obligations towards VP have been met by both the seller and the buyer, VP will pay the purchase price to the seller no later than 10 days after delivery notification by the seller as referred to in sub 34. However, if the buyer reports a defect or stable vice to VP in accordance with the provisions of paragraphs 38 to 41, and a dispute arises about this, VP is not obliged to pay the seller nor to refund the buyer. VP is only obliged to make the said payment to the seller or the said refund to the buyer if and as soon as the aforementioned dispute (among other things) has been settled in accordance with the provisions of paragraphs 38 to 41 in favor of the seller or the buyer respectively.

Absence of foals at the Auction

  1. A selected foal or embryo must participate in the Auction, failing which the seller must pay VP the costs it has incurred, with a minimum of €750 excl. VAT, as well as a compensation of €10,000. plus interest of 1.5% per month on the total owed, to be calculated from the date of the auction until the time of full payment. All this without prejudice to VP's right to compliance and/or compensation.
  2. If, in the opinion of the seller, a foal will not be able to participate in the auction due to health reasons, this must be communicated to VP in a timely manner, in writing and with a description of the condition, after which VP has the right to have a veterinarian designated by it determine the nature of the condition. diagnose the condition. The veterinary decision in this regard is binding. If the seller does not or does not offer sufficient opportunity to examine the foal (in a timely manner), or if the foal has been approved by that veterinarian and nevertheless does not participate in the auction, the seller is the one referred to in sub 30. compensation plus costs incurred is owed to VP.

Delivery, removal and delivery of foals

  1. Sellers are obliged to deliver their foal and mare to the auction site in good auction condition at a time to be specified by VP.
  2. The seller delivers the foal/surrogate mare with embryo to the buyer by transferring possession to the address to be specified by the buyer within the Netherlands, taking into account what is determined in paragraphs 34 to 37. The costs of delivery are borne by the seller. . If the buyer and/or seller lives outside the Netherlands, delivery will take place in consultation between both parties. Costs for transport abroad are for the buyer. Delivery takes place within the terms stated in these auction conditions.
  3. After the buyer has fulfilled his payment obligations (in accordance with the provisions of sub 20 or 22, thus payment to VP), VP reports the payment by the buyer to the seller as soon as possible. The seller must deliver the foal to the buyer after the payment has been reported by VP to the seller, within 7 days or in agreement with the buyer. The seller will notify VP in writing of the subsequent delivery as soon as possible by completing, signing and returning the proof of delivery form. An exception to this are the foals referred to in sub 35 and 36. Delivery thereof takes place in the manner stipulated under 35 and 36, whereby the aforementioned notification of delivery by the seller applies in full. Any delivery other than the aforementioned and otherwise stipulated in these auction conditions is entirely at the risk of the seller. Sellers must remove the foals, whether sold or not, from the auction site no later than three hours after the end of the auction. If the seller is in default, VP has the right to remove the foal from the auction site and store it elsewhere, whereby all costs reasonably incurred by and in VP's opinion will be for the account of the seller.
  4. If a foal is not delivered to the buyer within 3 months after the Auction, due to facts/circumstances that are within the buyer's sphere of risk, the foal will be at the buyer's expense and risk from the next day.

The delivery period stated in this subsection can only be deviated from in exceptional cases and after the intervention of VP. A foal with a known defect as referred to in sub 28 remains at the expense and risk of the seller until the moment of delivery to the buyer, taking into account the provisions of sub 38.

  1. Delivery to the buyer of a foal younger than 4.5 months on the risk transfer date stated in sub 34 must take place within 1 month after the time when the foal reaches that age. Delivery of a foal with a known defect as referred to in sub 28 to the buyer must, in the event of the recovery referred to in sub 28 and 38, be determined by the veterinary referred to in sub 28 and 38, within 1 month of recovery, but at the latest within 6 months after the auction.
  2. In any case, the buyer can only dispose of the foal / embryo after he has fully complied with his (payment) obligations, including those towards VP, whereby he will receive the necessary documents.

Stable Virtues and Flaws

  1. Sellers are obliged to deliver, auction and deliver their foals free of defects and stable vices and provide a corresponding guarantee. This guarantee does not cover the lack of OC and OCD in the foal and the presence of the wffs gene. If the law and/or jurisprudence about the relevant guarantee and/or its duration stipulate otherwise, the said mandatory other provision shall apply. If a foal is offered for sale with a defect known to both the seller and the buyer prior to the purchase, of which a veterinary designated by VP declares in writing that repair (cure) is possible, as referred to in sub 28, the seller assumes the obligation to keep the foal in his possession and to take care of recovery (healing), without this entailing extra costs for the buyer. Until the moment of delivery to the buyer, the foal remains at the expense and risk of the seller.
  2. If the buyer discovers stable vices in the purchased foal, such as crib biting, weaving or air sucking, not being a known defect as referred to in sub 28, the buyer must notify the new owner of this in writing within 7 days after delivery to the new owner, describing the nature of the to inform stable vices. VP will then house the foal at a location to be determined by it, in order to have the foal examined by a veterinarian to be designated by it for the stable vices described by the buyer. The veterinarian in question determines the nature and severity of the stable vices in a binding manner. If, in the opinion of the veterinarian, there are stable vices described by the buyer, the seller must pay the relevant costs incurred, including those relating to the stable, transport and veterinary care, to VP. The buyer must pay the said costs to VP if, in the opinion of the veterinarian, there are no stable vices described by the buyer.
  3. The provisions of sub 39 also apply if the buyer discovers defects in the purchased foal, other than a known defect referred to in sub 28 and other than stable vices referred to. The seller must immediately take back the foal at his own expense, in return for reimbursement of the purchase price, if the purchase is legally dissolved or annulled.
  4. If the buyer does not report the aforementioned stable vices or (other) defects in the aforementioned manner within the aforementioned period of 7 days after delivery and/or if the aforementioned veterinary surgeon does not establish the stable vices or (other) defects, the buyer's right to cancel the purchase will lapse. rescind or invoke a lack of will, unless the law and/or jurisprudence stipulate otherwise.

Veulenveiling Prinsjesdag 2026

Algemeen

  1. Veulenveiling Prinsjesdag BV (hierna: ‘VP’) organiseert in 2026 meerdere veilingen (hierna: ‘de Veiling’).
  2. De relatie tussen VP en de verkoper is een overeenkomst van opdracht.
  3. Deze veilingvoorwaarden zijn van toepassing op de relatie tussen VP en de verkoper en op de relatie tussen VP en de bieder/koper. Zowel de verkoper als de bieder/koper neemt geheel voor eigen rekening en risico deel aan de Veiling. VP is jegens de verkoper en de bieder/koper in geen geval gehouden tot meer of andere verplichtingen dan in deze veilingvoorwaarden omschreven. Zowel verkoper als koper stemmen bij inschrijven en bieding in met het feit dat de veiling contact op kan nemen via de opgegeven NAW gegevens. Ook kunnen partners van Veulenveiling Prinsjesdag contact opnemen voor promotionele acties en informatievoorziening.
  4. Een koopovereenkomst komt uitsluitend tot stand tussen de verkoper en de bieder/koper. De bieder/koper is evenwel verplicht de schriftelijke koopovereenkomst als bedoeld onder sub 11 te tekenen. VP is niet gebonden aan overeenkomsten tussen de verkoper en de bieder/koper. VP kan in geen geval als verkoper of bieder/koper worden aangemerkt.
  5. Alle bedingen in deze veilingvoorwaarden zijn mede gemaakt ten behoeve van al diegenen die voor of ten behoeve van VP werkzaam zijn of waren. De bepalingen in deze veilingvoorwaarden zijn rechtstreeks op deze (rechts)personen van toepassing, als waren zij zelf VP.
  6. De deelname aan de veiling wordt aangemerkt als aanvaarding van deze veilingvoorwaarden. Eventueel door een verkoper of bieder/koper gehanteerde voorwaarden worden hierbij uitdrukkelijk afgewezen.

Veiling

  1. VP dan wel een door VP samengestelde selectiecommissie onderzoekt en selecteert de embryo’s / veulens die in aanmerking komen voor deelname aan de Veiling. VP/de selectiecommissie is hierbij bevoegd, maar niet verplicht, advies in te winnen bij derden. VP/ de selectiecommissie heeft op elk moment het recht de deelname van een veulen of veulens aan de Veiling te weigeren op grond van (lichamelijke) gebreken, alsmede wegens andere door VP/de selectiecommissie te bepalen gronden, ook indien een veulen of veulens reeds voor de Veiling is of zijn geselecteerd. Een deelnamebesluit van VP/de selectiecommissie is bindend. VP/de selectiecommissie is/zijn nimmer gehouden om, op welke grond dan ook, de door de verkoper gemaakte kosten te vergoeden.
  2. De geselecteerde veulens worden verkocht voetstoots zonder actie of reactie, in de staat waarin zij zich bij gunning bevinden, teneinde door bieder/koper te worden opgefokt tot volwassen paard. De veulens worden bij opbod verkocht. Indien geen openingsbod wordt gedaan is de veilingmeester bevoegd met een verlaagd openingsbod te starten. De veilingmeester heeft het recht de volgorde van de te verkopen veulens te wijzigen of zonder opgave van redenen personen als bieder/koper te weigeren.
  3. Bieders/kopers worden geacht volledig handelingsbekwaam te zijn en bij het volle verstand. Iedere bieder/koper wordt geacht voor zichzelf te hebben gebo­den en is aan zijn bod gehouden totdat een hoger bod definitief is geaccep­teerd. Een bieder/koper is naast zijn eventuele lastgever volledig aansprake­lijk voor het niet nakomen van zijn verplichtingen. Een verkoper die zijn veulen terugkoopt, wordt beschouwd als bieder/koper en voor de alhier bedoelde verkoper gelden aldus eveneens alle bepalingen in deze veilingvoorwaarden die bieders/kopers betreffen.
  4. Eerst bij levering van het veulen door de verkoper aan de bieder/koper, gaat het risico ter zake het veulen over van de verkoper op de bieder/koper en wel onmiddellijk.
  5. De bieder/koper zal onmiddellijk na gunning onder vertoning van legitimatie een schriftelijke koopovereenkomst tekenen. Mocht de koopovereenkomst niet onmiddellijk aan de bieder/koper ter ondertekening worden aangeboden, dan dient hij zich direct na de veiling te melden bij het secretariaat van VP.

Informatie

  1. VP heeft gepoogd de catalogus met geselecteerde veulens voor de Veiling (hierna: de ‘Catalogus’) zo nauwkeurig mogelijk samen te stellen. De hierin opgenomen informatie, waaronder, maar niet uitsluitend, over de pedigrees is erop gericht een indruk te geven van de kwali­teit van de veulens, zonder de pretentie volledig te zijn.
  2. Het is de verantwoordelijkheid van de verkoper de juistheid van de informa­tie in de Catalogus te controleren en VP voor de Veiling schriftelijk te informeren over eventuele fouten/ onvolledigheden en noodzakelijke wijzi­gingen/ aanvullingen. In hoeverre eventuele wijzigingen/aanvullingen worden opgenomen in de Catalogus is ter vrije beoordeling van VP.
  3. De verkoper is verplicht voorafgaand aan de foto- /videodagen voor zijn rekening een veterinair rapport aan VP ter beschikking te stellen, afkomstig van een door hem aangewezen erkende veterinair. De verkoper dient voornoemd rapport voorafgaand aan de foto- /videodagen aan VP te verstrekken. Tijdens voornoemde foto-/videodagen alsmede op de veilingdag (bij fysieke veiling) voorafgaand aan de Veiling, is een door VP aangewezen veterinair aanwezig die in opdracht en risico van de verkoper het aangemelde veulen inspecteert en het voornoemde veterinair rapport controleert. Er zal een klinische keuring plaatsvinden. Als deze veterinair onjuistheden of onvolledigheden constateert, zal hij zijn bevindingen hechten aan het eerder opgestelde veterinair rapport. Op de dag van de Veiling kunnen verkoper en bieder/koper een afschrift van het veterinair rapport inclusief eventuele aangehechte bevindingen inzien.
  4. De bieders/kopers zijn verplicht op verzoek van VP informatie te verschaf­fen omtrent hun financiële gegoedheid, onderbouwd aan de hand van bescheiden waaruit deze gegoedheid blijkt.

Kosten en betaling

  1. Alle tarieven en prijzen in deze veilingvoorwaarden zijn exclusief btw. Over de koopsom en het commissiebedrag wordt btw in rekening gebracht.
  2. Het door de verkoper te betalen commissiebedrag wordt vastgesteld op basis van 12% excl. BTW. Het minimum inschrijfgeld van € 500,- excl. btw per veulen en het minimum inschrijfgeld van € 500,- excl. voor een embryo is door de verkoper aan VP verschuldigd vanaf het moment dat de verkoper het contract heeft ondertekend.
  1. Veulens; Indien de hoogste bieding afkomstig is van de verkoper van een veulen, is hij tot en met € 7.000,- geen koperscommissie verschuldigd. Indien deze bieding hoger is dan €7.000,- is verkoper zowel koperscommissie als verkoperscommissie verschuldigd.

Embryo’s; Indien de hoogste bieding afkomstig is van de verkoper van een embryo, is hij een additionele € 500,-verschuldigd. Indien deze bieding hoger is dan € 10.000,- is verkoper tevens het opgeld (commissie koper) verschuldigd, overeenkomstig het bepaalde in sub 20 en volgende van deze voorwaarden.

  1. Verkoper dient het minimumbedrag aan inschrijfgeld binnen 14 dagen na factuurdatum te voldoen op de bankrekening van Veulenveiling Prinsjesdag BV onder vermelding van het factuurnummer. Enkel na ontvangst van voormeld bedrag, dan wel een betalingsbewijs hiervan, worden verkoper en zijn veulen(s) toegelaten tot de Veiling.
  2. De bieder/koper dient de koopsom, vermeerderd met 12% opgeld excl. btw over de koopsom, na ontvangst van de factuur zo spoedig mogelijk te betalen. In euro’s zonder enige korting of inhouding.
  3. Indien de koper zijn verplichtingen uit hoofde van sub 20 niet nakomt, heeft VP het recht het veulen/ embryo opnieuw te veilen, waarbij het bod van de oorspronkelijke koper niet wordt aanvaard. De oorspronkelijke koper is gehouden het verschil tussen zijn bod en de lagere koopsom bij de tweede veiling, alsmede de daarmee gepaard gaande kosten aan VP te voldoen. De koper heeft geen aanspraken jegens VP ingeval een hogere opbrengst wordt gerealiseerd bij de tweede veiling.
  4. Veulenveiling Prinsjesdag verkoopt niet aan gesanctioneerde landen. Overigens is Veulenveiling Prinsjesdag niet aansprakelijk voor eventuele doorverkoop aan derden in gesanctioneerde landen.
  5. Alleen de door VP erkende commissionairs die voor aanvang van de veiling bij het secretariaat van VP schriftelijk hebben opgegeven dat zij optreden voor één of meer van de bieders/kopers, kunnen aanspraak maken op provisie vanaf een verkoopbedrag van € 22.000,- excl. btw per veulen of embryo. Deze provisie bedraagt 5% excl. btw over de gehele koopsom. De commissionair zal na ondertekening van het koopcontract gelijkwaardig zijn als zijnde koper en aan de in deze algemene voorwaarden genoemde verplichtingen worden gehouden en verantwoordelijk zijn voor een correcte (financiële) afhandeling. Nadat de bieder/koper geheel aan zijn (betalings)verplichtingen heeft voldaan en het veulen is afgeleverd bij koper, is VP, niet eerder dan twee weken na levering, de provisie verschuldigd.
  6. Betaling aan enig ander dan VP bevrijdt de verkoper, dan wel de koper niet van zijn betalingsverplichtingen jegens VP. Zolang VP geen algehele betaling van de koper heeft ontvangen blijft de verkoper eigenaar van het veulen.
  7. Indien VP niet binnen 30 dagen na de veiling algehele betaling van de verkoper en/of koper heeft ontvangen, is de verkoper en/of koper van rechtswege in verzuim en een vergoeding verschuldigd aan VP ter hoogte van 12% over de koopsom, vermeerderd met een rente van 1,5% per maand over het totaal verschuldigde, te berekenen vanaf de veiling tot het tijdstip van algehele betaling. Een en ander onverminderd het recht van VP op nakoming en/of schadevergoeding.
  8. Indien VP niet binnen 30 dagen na de veiling algehele betaling van de koper heeft ontvangen, heeft VP voorts het recht zonder ingebrekestelling namens de verkoper en zonder zijn toestemming de koop als ontbonden te beschouwen. De verkoper en de koper blijven in dat geval jegens VP gehouden om aan al hun in deze veilingvoorwaarden genoemde betalingsverplichtingen te voldoen, voor zover deze een vergoeding ten behoeve van VP betreffen.
  9. Indien de koper of de verkoper zijn (betalings)verplichtingen jegens VP niet nakomt, komen alle (buiten)gerechtelijke kosten die VP daardoor maakt voor rekening van de koper dan wel de verkoper, met een minimumbedrag van € 1.000,-.
  10. Indien sprake is van een veulen met een bekend gebrek waarvan een door VP aangewezen veterinair schriftelijk heeft verklaard dat herstel (genezing) mogelijk is, dan is de koper verplicht conform de voorwaarden in sub 20 tot en met 27 aan zijn verplichtingen te voldoen. Bij dood of afkeuring van een veulen door de vorenbedoelde veterinair, die omtrent de gezondheidstoestand van het veulen bindend beslist, vóór het verstrijken van de termijn waarbinnen levering door de verkoper aan de koper had dienen plaats te vinden, wordt de koopovereenkomst als ontbonden beschouwd en de koopsom met de daarover eventueel verschuldigde btw door VP gerestitueerd. Het inschrijfgeld en het opgeld worden door VP niet aan de verkoper respectievelijk de koper gerestitueerd c.q. blijven aan VP verschuldigd. Voor wat betreft de termijn(en) waarbinnen levering van vorenbedoeld veulen met gebrek dient plaats te vinden, wordt verwezen naar het bepaalde in sub 36.
  11. Indien en pas nadat aan alle (betalings)verplichtingen jegens VP zijn voldaan door zowel de verkoper als de koper, zal VP uiterlijk 10 dagen na leveringsmelding door verkoper als bedoeld in sub 34, de koopsom aan de verkoper voldoen. Indien de koper overeenkomstig het bepaalde in sub 38 tot en met 41 aan VP melding maakt van een gebrek of stalondeugd, en daarover een geschil ontstaat, is VP echter niet gehouden tot betaling aan de verkoper, noch tot terugbetaling aan de koper. VP is eerst gehouden tot bedoelde betaling aan de verkoper of bedoelde terugbetaling aan de koper, indien en zodra vorenbedoeld geschil (o.a.) overeenkomstig het bepaalde sub 38 tot en met 41 ten voordele van de verkoper respectievelijk de koper is afgewikkeld.

Afwezigheid veulens op de Veiling

  1. Een geselecteerd veulen of embryo dient aan de Veiling deel te nemen, bij gebreke waarvan de verkoper aan VP de door haar gemaakte kosten, met een minimum van € 750,- excl. btw dient te voldoen, alsmede een vergoeding ter grootte van € 10.000, vermeerderd met een rente van 1,5% per maand over het totaal verschuldigde, te berekenen vanaf datum veiling tot het tijdstip van algehele betaling. Een en ander onverminderd het recht van VP op nakoming en/of schadevergoeding.
  2. Indien een veulen naar oordeel van de verkoper wegens gezondheidsredenen niet aan de veiling zal kunnen deelnemen, dan dient dit tijdig, schriftelijk en met omschrijving van de aandoening aan VP te worden medegedeeld, waarna VP het recht heeft een door haar aangewezen veterinair de aard van de aandoening te doen vaststellen. De vaststelling van die veterinair ter zake is bindend. Indien de verkoper aan en naar bindend oordeel van die veterinair geen c.q. onvoldoende gelegenheid biedt het veulen (tijdig) te onderzoeken, dan wel indien het veulen door die veterinair is goedgekeurd en desondanks niet aan de veiling deelneemt, is de verkoper de in sub 30 genoemde vergoeding plus gemaakte kosten aan VP verschuldigd.

Aanlevering, verwijdering en levering veulens

  1. Verkopers zijn verplicht hun veulen en merrie op een door VP aan te geven tijdstip in een goede veilingconditie op het veilingterrein aan te leveren.
  2. De verkoper levert het veulen /draagmerrie met embryo aan de koper door bezitsverschaffing op het door de koper binnen Nederland aan te geven adres, met inachtneming van hetgeen is bepaald in sub 34 t/m 37. De kosten van levering zijn voor rekening van de verkoper. Indien de koper en/of verkoper buiten Nederland woonachtig is, zal de levering in overleg tussen beide partijen plaatsvinden. Kosten voor het transport naar het buitenland zijn voor de koper. Levering vindt plaats binnen de in deze veilingvoorwaarden genoemde termijnen.
  3. Nadat de koper aan zijn betalingsverplichtingen heeft voldaan (overeenkomstig het bepaalde in sub 20 dan wel 22, aldus betaling aan VP) meldt VP de betaling door de koper zo spoedig mogelijk aan verkoper. De verkoper dient het veulen nadat de betaling door VP aan verkoper is gemeld aan koper te leveren, binnen 7 dagen of in overeenstemming met de koper. De verkoper meldt de daaropvolgende levering zo spoedig mogelijk schriftelijk aan VP door het formulier ‘bewijs van levering’ in te vullen, te ondertekenen en aan VP te retourneren. Uitzondering hierop zijn de in sub 35 en 36 bedoelde veulens. Levering daarvan vindt plaats op de wijze als bepaald sub 35 en 36, waarbij de vorenbedoelde melding van levering door de verkoper onverkort van toepassing is. Elke levering anders dan voormeld en overigens bepaald in deze veilingvoorwaarden is volledig voor risico van de verkoper. Verkopers dienen de al dan niet verkochte veulens uiterlijk binnen drie uur na afloop van de veiling van het veilingterrein te hebben verwijderd. Indien de verkoper hiermee in gebreke is, heeft VP het recht het veulen van het veilingterrein te verwijderen en elders te stallen, waarbij alle in redelijkheid door en naar oordeel van VP te maken kosten voor rekening komen van de verkoper.
  4. Indien een veulen niet binnen 3 maanden na de Veiling aan de koper is afgeleverd, vanwege feiten/omstandigheden die in de risicosfeer van koper zijn gelegen, is het veulen vanaf de eerstvolgende dag voor rekening en risico van de koper.

Van de in dit sub vermelde leveringstermijn kan alleen worden afgeweken in uitzonderlijke gevallen en na tussenkomst van VP. Een veulen met een bekend gebrek als bedoeld in sub 28 blijft tot het moment van levering aan de koper voor rekening en risico van de verkoper, met inachtneming van het bepaalde in sub 38.

  1. Levering aan de koper van een veulen jonger dan 4,5 maand op de in de sub 34 vermelde risico overdrachtsdatum dient binnen 1 maand na het tijdstip waarop het veulen die leeftijd bereikt plaats te vinden. Levering van een veulen met een bekend gebrek als bedoeld in sub 28 aan de koper dient ingeval van het in sub 28 en 38 bedoelde herstel, vast te stellen door de in sub 28 en 38 bedoelde veterinair, binnen 1 maand na herstel doch uiterlijk binnen 6 maanden na de veiling plaats te vinden.
  2. De koper kan in ieder geval pas nadat hij volledig aan zijn (betalings)verplichtingen heeft voldaan, waaronder mede begrepen die jegens VP, over het veulen / embryo beschikken, waarbij hij de benodigde bescheiden zal ontvangen.

Stalondeugden en gebreken

  1. Verkopers zijn verplicht hun veulens vrij van gebreken en stalondeugden aan te leveren, te laten veilen en te leveren en geven een dienovereenkomstige garantie af. Niet onder deze garantie valt het ontbreken van OC en OCD bij het veulen en de aanwezigheid van het wffs-gen. Indien de wet en/of jurisprudentie over betreffende garantie en/of duur daarvan dwingend anders bepalen, geldt bedoelde dwingende andere bepaling. Indien een veulen ter verkoop wordt aangeboden met een voorafgaand aan de koop bij zowel de verkoper als de koper bekend gebrek waarvan een door VP aangewezen veterinair schriftelijk verklaart dat herstel (genezing) mogelijk is, als bedoeld in sub 28, dan neemt de verkoper de verplichting op zich het veulen onder zich te houden en voor herstel (genezing) zorg te dragen, zonder dat dit voor de koper extra kosten met zich meebrengt. Het veulen blijft tot het moment van levering aan de koper voor rekening en risico van verkoper.
  2. Indien de koper bij het gekochte veulen stalondeugden constateert, zijnde kribbebijten, weven of luchtzuigen, niet zijnde een bekend gebrek als bedoeld sub 28, dient de koper uiterlijk binnen 7 dagen na levering bij de nieuwe eigenaar VP hiervan schriftelijk met omschrijving van de aard van de stalondeugden op de hoogte te stellen. Alsdan zal VP het veulen op een door haar te bepalen locatie onderbrengen, teneinde het veulen door een door haar aan te wijzen veterinair op de door de koper omschreven stalondeugden te laten onderzoeken. De bedoelde veterinair stelt de aard en ernst van de stalondeugden bindend vast. Indien naar oordeel van die veterinair van door de koper omschreven stalondeugden sprake is, dan dient de verkoper de ter zake gemaakte kosten, waaronder voor wat betreft de stalling, het transport en die veterinair, aan VP te voldoen. De koper dient de bedoelde kosten aan VP te voldoen indien naar oordeel van die veterinair geen sprake is van de door de koper omschreven stalondeugden.
  3. Het bepaalde in sub 39 geldt eveneens indien de koper bij het gekochte veulen gebreken, anders dan een in sub 28 bedoeld bekend gebrek en anders dan bedoelde stalondeugden, constateert. De verkoper dient het veulen direct en op eigen kosten terug te nemen, tegen terugbetaling van de koopsom, indien de koop rechtsgeldig wordt ontbonden of vernietigd.
  4. Indien de koper niet binnen voornoemde termijn van 7 dagen na levering op voornoemde wijze melding maakt van bedoelde stalondeugden of (andere) gebreken en/of indien voornoemde veterinair de stalondeugden of (andere) gebreken niet vaststelt, vervalt het recht van de koper de koop te ontbinden of een beroep te doen op een wilsgebrek, tenzij de wet en/of jurisprudentie daaromtrent dwingend anders bepalen.
